Abstract

O mito é uma fala. Segundo Roland Barthes, há uma forma de significação que constitui o cotidiano das relações sociais na medida em que seu significado é esvaziado em prol da repetição de seu significante. Nessa repetição, a teoria dos atos de fala tratadas por Jacques Derrida expõem a possibilidade de criticar o processo de violência mítica que institui o direito e suas formas de enunciação. Pretende-se analisar de que forma é possível identificar uma injunção entre Direito, mito e violência na constituição dos Direitos Humanos na modernidade.
